A car accident lawsuit is filed by the injured party or by relatives or friends on behalf of the injured party. Since a car accident occurs when the car is faulty or due to another driver's negligence, it makes sense to file a case either against the manufacturer or the driver who caused the accident due to reckless driving. Some lawsuits have also been filed against the government for negligence that could have resulted in bad road conditions that might have caused an accident like a roll over or skid.

Most car accidents happen on busy roadways such as expressways, freeways, or highways with high speed limits. In such instances, if even just one driver neglects to follow proper driving rules or guidelines, it might result in a pileup resulting in excessive property damage and personal injuries. Teenagers who do not follow basic safety rules such as wearing a seat belt and passing with proper signals cause many car accidents. People who drink alcohol or take drugs are another major cause of car accidents are usually held liable if involved in an accident.

A properly filed lawsuit can help the injured party get compensation for their traumatic experience. In the cases mentioned above, the guilty party must pay for the medical bills and the property damage caused by the accident. Also, costs for any hospitalization to be done must be covered by the guilty party. Most common personal injuries caused during an accident are the knee injuries, spinal cord injuries, and brain injury due to shock.
